These Terms of Use govern access to and use of the Formation Pro online training platform.
By accessing the platform or creating an account, the user acknowledges having read these terms and agrees to be bound by them.
Access to the Platform
Access to the platform is limited to:
- Individually registered users
- Users invited by a client organization
The user is responsible for maintaining the confidentiality of their login credentials and for all activities carried out through their account.
Account Creation
When registering, the user must provide accurate and up-to-date information.
The user agrees to:
- Not impersonate another person
- Not share their access with a third party
- Promptly notify the organization of any unauthorized use of their account
The organization reserves the right to suspend or deactivate an account in the event of non-compliant use.
Acceptable Use
The user agrees to use the platform:
- In compliance with applicable laws
- For legitimate training purposes
- Without compromising the security or integrity of the system
In particular, it is prohibited to:
- Attempt to access unauthorized data
- Disrupt the technical operation of the platform
- Reproduce or distribute content without authorization
Intellectual Property
The content of the platform (texts, modules, videos, assessments, documents, logos, and instructional structure) is protected by applicable intellectual property laws.
Unless expressly authorized in writing, no content may be:
- Reproduced
- Modified
- Distributed
- Used for commercial purposes
Licenses granted to users are limited to personal or internal organizational use, as applicable.
Certificates and Assessments
Certificates are issued subject to:
- Completion of the training program
- Successful completion of assessments, where applicable
The organization does not guarantee that the training meets the specific requirements of a professional order or external body, unless explicitly stated otherwise.
Service Availability
Reasonable efforts are made to ensure continuous availability of the platform.
However, temporary interruptions may occur, including for:
- Maintenance
- Updates
- Technical improvements
- Circumstances beyond reasonable control
No absolute guarantee of uninterrupted availability is provided.
Limitation of Liability
The platform is provided for educational and informational purposes only.
The organization shall not be held liable for:
- Decisions made based on training content
- Improper use of the information provided
- Indirect damages or losses resulting from the use of the platform
Protection of Personal Information
Use of the platform is also governed by the Privacy Policy, which forms an integral part of these Terms of Use.
Payments and Billing
Where fees apply:
- Payment terms are specified at the time of purchase
- Payments are processed by an external provider
- Access may be suspended in the event of non-payment
- Fees paid are non-refundable, unless otherwise stated or required by applicable law
Suspension or Termination
Access may be suspended or terminated in the event of:
- Failure to comply with these Terms
- Abusive or fraudulent use
- Violation of intellectual property rights
Amendments
These Terms may be modified at any time.
The version in force is the one published on the platform at the time of use.
Governing Law
These Terms are governed by the laws applicable in the Province of Québec and the applicable federal laws of Canada.
Any dispute shall be submitted to the competent courts of the applicable judicial district in Québec.
